1. General Conditions

The General Conditions shall form an integral part of the Sales Contract. Any contrasting or divergent conditions, as well as any integration and/or change and/or derogation to them have no effect, unless they are stated through a contract established and signed by the parties.

2. Definition and Object of the Contract

The Contract is composed of the conditions hereby stated in the General Terms of Sale, in the Order Form and, where appropriate, in the attachments established and signed by the parties.

3. Order Proposals

The validity of order proposals is subject to prior acceptance of the General Terms of Sale by the customer.

4. Prices

The prices of all products are VAT included. After the purchase process, delivery charges can be added depending on the customer’s address (abroad).

5. Purchase and Method of Payment

Within 24 hours from the purchase, the customer can withdraw from the contract and obtain the complete refund without any penalties and without the need to specify the reasons. After 24 hours have passed, the order cannot be canceled, because of the beginning of the working process for the tailor-made clothing.

6. Delivery and Claims

The time necessary for the production of the different tailor-made clothes are specified when choosing the product. Sarti per passione delivers the products at the address provided by the customer within 35 working days from the acceptance of the Contract (with a margin of tolerance of max. 10 days). During national holidays and bank holidays, some delays may occur due to the closure of the facilities. When the goods are shipped, the customer will receive an e-mail at the provided address containing the tracking number to monitor the delivery progress managed by the courier service.

7. Changes and Refund Policy

In case of any changes made to adjust waist and sleeves length and/or other small tailoring works, the customer can address directly to his or her personal tailor. The customer will be refunded for the charges (up to max. 50 €).

8. Return Policy

For made-to-measure and completely custom orders, the article of law 59 lettera c del Codice del Consumo (Eccezioni al diritto di recesso) in deroga agli articoli dal 52 al 58 dello stesso Codice applies. Nevertheless, in order to offer a high-level service and the maximum customer satisfaction, if the product has structural imperfections (all features different from what previously specified in the order, or manufacturing faults that highlight a difference from the common sartorial procedures, e.i. buttons that are not well-distanced, non-compliant buttonholes, wrong cuts, etc.), Arbiter Elegantiae will completely refund the customer for the amount paid (except for shipping costs) after the return of the products, within 30 days from the receipt. Only new, whole and not damaged clothes will be accepted and refunded.

Once the customer writes an e-mail, he or her will receive a return form to be resent attaching 3 pictures of the clothing piece (front, back and side images), so that it can be well visible.

The pictures will be reviewed by the Personal Sartorialist team who will communicate with the customer for the claim approval. The customer shall send back the product to be returned in its original box, together with the return approval communication, at its own expense, to the following address:

The amount will be credited at the receipt of the product/s.

9. Force Majeure

The society licensee for the brand Arbiter Elegantiae cannot be considered responsible for any default due to force majeure or to infringements that cannot be attributed to the society. Force majeure shall mean any natural disaster or event that is not under control of the party, such as, for example, riots, war, floods, earthquakes, strikes, government measures or other facts beyond the control of the party.

10. Applicable Law and Competent Courts

The present Terms of Sale and the Contract shall be considered as made under Italian law. In case of any disputes, they are subject to the exclusive jurisdiction of the court of Terni.
